Licensed premises | Licensing appeals

Following a licensing hearing before a sub-committee, should you be dissatisfied, you have the right to appeal to the Magistrates’ Court. We have extensive experience of Licensing Appeals and will guide you through the process, advising you on the best strategy both commercially and practically.

An appeal must be lodged within 21 days of receiving the decision from the licensing authority. Preparation for an appeal hearing in the Magistrates’ Court may take several months.

Following an appeal hearing, the court has the power to make the following orders:

  • Dismiss the appeal
  • Amend the decision of the licensing authority
  • Ask the licensing authority to reconsider the application

Leading up to the appeal hearing, we continually liaise with the licensing authority with an aim to negotiate a favourable settlement on your behalf.

We have successfully acted for a number of clients in relation to their appeals. We have also been able to recover client’s costs.

Case Studies

  • Acting for a Brighton coffee shop which had a premises licence application refused. The premises were located within a cumulative impact area which meant there was a presumption of refusal. We negotiated a settlement on appeal which involved our client obtaining a premises licence and having his costs paid.
  • We acted for a licence holder who had been prosecuted for being in possession of non-duty paid cigarettes which also did not carry the correct health warnings. Our client had his premises licence revoked by the Licensing Authority following a review brought by Trading Standards. Following our client’s acquittal in the criminal proceedings, his appeal against the decision to revoke his premises licence was upheld.
