Here in the UK, we may not have the most promising weather, but during that one week of sunshine it’s very difficult to enjoy an evening drink when weaving through fellow drinkers in a cramped smoking area. London, for example, has over 17,000 restaurants but unfortunately does not benefit from a great deal of outdoor space, and the restaurants’ customers may well want to enjoy their brunch or evening drinks in an outside seating area.

We have considerable experience advising on planning permission and obtaining ‘tables and chairs licences’ in Special Policy Areas and Cumulative Impact Zones such as Westminster, and dealing with any concerns from local residents and neighbours in a delicate manner. When applying for permission to place tables and chairs on the highway, you may wish to request permission to place windbreaks, umbrellas, space heaters or planters in the designated outside area.  The proposed furniture must be of reasonable quality, durable and weatherproof, and must not:

  • Obstruct the highway and allow sufficient pavement space for pedestrians
  • Create a safety hazard
  • Create noise nuisance to neighbouring properties
  • Lead to nuisance due to litter
  • Create or lead to crime and disorder
