Fee Estimates: Uncontested Probate Matters (Cardiff)

Uncontested probate – Full administration of the Estate

Our team can guide you through the probate and estate administration process and we aim to make it as straightforward as it can be. Using our extensive experience, we will prepare the relevant documents and liaise with the concerned parties should there be questions.

Range of costs

When acting in such matters costs are calculated based on our hourly fee rates.  The cost of your matter will depend upon its complexity, however below are some examples.

Grant of Probate/Letters of Administration:  £800 to £4,000 plus VAT (currently 20%)

Full administration of an estate: £3,000 to £10,000 plus VAT (currently 20%)

A complex Estate administration, e.g. .taxable Estates, Estates which include multiple assets, foreign assets etc. will naturally take a longer time and will therefore amount to a figure towards the higher end of the fee scale.

Less complex Estate administration, e.g. non-taxable Estates or an Estate with few assets, will amount to a figure towards the lower end of the fee scale.

The Administration of an Estate would include:

  • Advising the Executor/Administrator on the provisions of the Will/Rules of Intestacy.
  • Advising on the Estate’s Inheritance Tax liability.
  • Obtaining instructions from the Executors/Administrators and offering general advice.
  • Scheduling the assets and liabilities of the Estate.
  • Acquiring the Grant of Probate/Letters of Administration (to include drafting of Inheritance Tax paperwork and the Oath for Executors/Administrators) and lodging it with all interested parties to obtain release of assets.
  • Settling the Estate liabilities.
  • Arranging (if appropriate) interim distributions from the Estate.
  • Finalising tax matters.
  • Drafting estate accounts and making final distributions from the Estate.  Ahead of concluding the administration we will ensure that any trusts created pursuant to the terms of the will are put in place.
  • All correspondence, advice and attendances.

There are a number of factors that can increase the complexity of the administration of an Estate and in turn increase legal costs. These can include, but are not limited to:

  • Disagreements between Executors and/or beneficiaries.
  • Estate’s tax liability, application for reliefs, the need to submit corrective accounts or claim’s for loss relief from HMRC
  • Negotiations with District Value and HMRC re: property valuations and business property
  • Enquiries made by HMRC
  • Difficulty in obtaining information from third parties – asset providers, HMRC, Executors etc.
  • Delays in property or other assets being sold

There are a number of ways in which the Executors/Administrators can assist with the administration of the Estate which will in turn minimise costs. Examples include:

  • Responding to queries and requests for information and documentation promptly
  • Acquiring date of death balances/value of assets, supervising probate property

Additional disbursements:

Disbursements that may need to be paid in addition to the above legal costs include (but are not limited to):

  • Probate fees – £157 plus 50p per copy of the Grant of Probate/Letters of Administration (current rates)
  • Swear fees – £5.00- £7.00 per Executor/ Administrator
  • Land Registry fees – variable
  • Valuation fees – chattels, property, business assets, agricultural assets etc. – variable
  • Insurances – property/contents insurance – variable
  • House clearance – variable
  • Statutory notices – variable
  • Bankruptcy searches – £2 per search
  • Tracing Application – variable

Our team estimate on average the administration of an Estate takes approximately 6 to 9 months and costs in the region of £4000 plus VAT (currently 20%).
