Carl advises clients in the international trade and shipping sectors, specialising in commodity trading, carriage of goods and charterparty disputes. His clients include commodity traders, shipowners, cargo interests, P&I Clubs and freight forwarders.

Carl advises on all aspects of commodity trading disputes, with an emphasis on oil and gas trading. He advises clients on a wide range of matters arising under sale and purchase contracts, including disputes relating to delivery obligations, quality claims, cargo shortages, payment obligations and documentary credits. He also advises clients on the shipping aspects of their operations.

His experience extends to advising on the terms of sale and purchase contracts, as well as drafting and negotiating joint venture agreements for the sale and purchase of various commodities.

In the shipping sector, Carl advises on a range of issues arising under charterparties and bills of lading. He is experienced in cases relating to the carriage of goods by sea and also advises freight forwarders on multimodal transport issues.

In addition to litigation in the English Courts, Carl has been involved with numerous arbitrations and has experience of Alternative Dispute Resolution.

Highlight Matters

  • Advising an oil reader in a multi-million dollar dispute arising from alleged breaches of quality specifications.
  • Acting for a major trader in arbitration proceedings defending a claim commenced by a former commercial agent seeking payments totalling around US$ 7 million.
  • Successfully representing a global food producer at the Court of Appeal in an appeal against import duty classifications imposed on its products by HMRC.
  • Advising oil trading clients in relation to the bankruptcy of an oil refinery with which it had entered a long term prepayment and offtake agreement.
  • Representing a steel mill in ICC arbitration defending substantial claims arising from alleged deficiencies in the quality of product delivered.
  • Advising slot charterers in relation to multi-million dollar cargo claims arising out of the total loss of a container ship carrying over 4,000 containers.
  • Acting for charterers in Commercial Court proceedings, pursuing substantial damages against the ship owners for breaches of the charterparty seaworthiness obligation.
