Nick Goldstone

You, Nick Goldstone
& Ince, in any case

Nick is the Head of Ince’s London Dispute Resolution Department, specialising purely in commercial litigation and other forms of dispute resolution. For approximately 18 months, following the merger of Ince & Co and Gordon Dadds, Nick was a Joint Managing Partner of the combined London offices of the merged firms. Nick’s work has a particular emphasis on media related disputes, reputation management and human rights. Nick is an accredited Solicitor Advocate with Higher Rights of Audience in all civil courts and has practised in litigation and dispute resolution throughout his career.

Nick has extensive experience in advising on matters concerning civil fraud and also acting in a wide range of commercial litigation cases. Whilst he usually acts for the private client side, rather than the institutional side on any case where there are opposing parties of different type, he is happy acting for claimant or defendant.

In the past few years Nick has acted in a multi-million pound unfair prejudice proceeding in Gibraltar; another multimillion pound joint-venture property investment dispute concerning business interests in Morocco; and in an international racketeering dispute involving New York, Switzerland, Israel, Lichtenstein and the UK.

On reputation management cases Nick invariably acts for the claimant and is very adept in taking on both print and broadcast media for very high profile individuals who invariably have exemplary public profiles.

Nick joined Ince in 2014 from another leading London law firm.

Quote

"My role in dealing with disputes is to try to achieve the best outcome to a case for the client that is legally possible and economically viable. Commercial considerations should always be borne in mind. I like to win, and dislike losing with a passion. I am responsive, practical and pragmatic. I also enjoy seeking solutions that are not always obvious, nor necessarily expected (particularly by the opponents). The best cases to win are those that you think you might, or should, lose as when that happens, you are really making a difference and that is very satisfying".

What you may not know about Nick

Away from work and when not managing the Dispute Resolution Department, Nick enjoys spending time with his family, walking the dog and following sport, not least his favourite football team – “living the dream” – Brentford Football Club.

My matter highlights

  • Acting for John Lydon (aka "John (Jonny) Rotten") of Public Image Limited -PiL- and one of the founding members of the Sex Pistols.

  • Appearing before Lord Justice Neuberger as a Solicitor Advocate in the Court of Appeal on a Civil Restraint appeal and winning the appeal with only three words needing to be said, in view of the quality of the written skeleton argument.

  • Acting for the late Dudley Moore in an unpleasant dispute with the BBC over an Omnibus television programme and securing important changes to the programme about the man and his great musical talent, before it was broadcast and licensed worldwide.

  • Acting in the Data Protection Tribunal against the Data Protection Commissioner’s Office [now the Information Commissioner] and successfully securing an Order for specific disclosure of documents from the Commissioner together with a costs award, the Commissioner wrongfully seeking to argue that the documents sought were privileged.

  • Winning at trial when the judge described the client as “..a singularly unimpressive witness upon whose uncorroborated evidence I am unable to place any reliance. It began with his name..”  The case turned on expert evidence, which had been obtained to substantiate the client’s supposed untrustworthy testimony.

  • Acting for The Face in defence of the Jason Donovan defamation case in 1992 and in the subsequent "Lemon Fund" appeal process resulting in the iconic magazine going from strength to strength.

  • Acting for Peter Buck (REM guitarist) in the air rage matters relating to his flight from Seattle to London in 2001.  Securing the stay of civil proceedings brought by key prosecution witnesses, which in turn helped the defence team secure an acquittal in the Crown Court.

  • Being successful in Judicial Review proceedings against HM Prison Services and more than one Local Authority in different cases.

  • Winning a contract case over an expensive Show jumping Horse, following a successful application for specific disclosure of immigration records of the opponent which the court initially thought would be irrelevant, but disclosure proved to be of crucial importance in the case.
