From 6 April 2020, employers must provide a written statement of terms from day one

On 17 December 2018, the government published the Good Work Plan which promised changes to written statements of terms which are coming into force on 6 April 2020.
  • At the moment employers are required to provide employees with certain specified terms such as: pay; hours of work; holiday entitlement; provision of sick pay; length of notice; pension rights and any applicable disciplinary rules or grievance procedures, no later than two months after the date the employee starts work. The written information can be given at different times, provided it is all given within by the end of the two month period (certain information, however, must be provided in a single document).  From 6 April 2020, the majority of particulars will need to be given in a single statement on or before the date the employment begins.
  • Currently, employers are only obliged to provide a written statement of terms to employees whose employment is to continue for one month or more, whereas from 6 April 2020 the minimum service requirement will be gone.
  • Further, the obligation on employers to provide a written statement of particulars will be extended to workers, as well as employees.
  • The statement will now have to provide additional information such as: any other remuneration and benefits; any paid leave to which the worker is entitled; and any probationary period, including any conditions and its duration.
