Ince Asia Team successfully held the third mock arbitration in China on 11 July in Guangzhou, with a full-house.

17.07.2019

The mock arbitration simulated an actual hearing of a Hong Kong international arbitration involving an international trade dispute that has shipping, trade, insurance and contract aspects, in line with one of the important roles that Hong Kong is playing under China’s Greater Bay Area initiative, that is, the role of being the legal services centre and dispute resolution centre of the world.

The event takes advantage of Ince’s long-standing dispute resolution capabilities as well as Hong Kong being a legal and dispute resolution hub, providing clients in Asia Pacific and around the globe with all-around services in international arbitration. The event was overwhelmingly well received by the attendees, who were impressed by the very "real-life" nature of the hearing and expressed immense interest in attending more of such events in the future. To quote one of the attendees, “I thoroughly enjoyed the show, especially the cross examination of the witnesses”. Others described it as "very inspiring" and “very rewarding”. The "case" adapted from an actual arbitration case consisting of witness statements, bundles of documents and real-life witnesses, the advocates and witnesses, and simulates a hearing under HKIAC rules.

Once again, we had a very high turn-up rate and a full house. Attendees included shipping companies, traders, brokers, insurers, marine arbitration commission, ship owners association, P&I Clubs, average adjusters, shipyards, logistics operators and leasing companies. They are, inter alia, COSCO Shipping Bulk Co Ltd, COSCO Shipping Specialized Carriers Co Ltd, PICC Guangdong, Guangzhou and Shenzhen Branches, Ping An Insurance, Donghai Insurance, Shenzhen Energy Transportation Co Ltd, Complant, Hong Kong Ship Owners Association, COSCO Insurance Brokers (Hong Kong), COSCO Hong Kong, CPI Services Hong Kong, China Merchants Insurance, China Merchants Energy Transportation, Steamship Mutual Services Hong Kong, Richard Hoggs, Average Adjusters Company, Express Marine Electronics, ICS HK, some of whom travelling from Beijing, Ningbo, Shenzhen and all the way from Hong Kong.

Rosita Lau, a Senior Partner of Hong Kong office and Paul Ho, Managing Partner of Shanghai office and Head of Greater China, kicked off the event with welcome address. The mock arbitration "ensemble" consisted of our team of lawyers across our Asian offices from Hong Kong, Shanghai, Beijing and Singapore. Rosita Lau acted as the sole and presiding Arbitrator. The Claimant’s Counsel were Wai Yue Loh (Managing Partner of Beijing office) and Ruaridh Guy (Managing Associate of Hong Kong office) while the Respondent’s Counsel were Nicholas Lum (Partner of Shanghai / Singapore offices) and Peter Huang (Associate of Singapore office), with Wai Yue Loh and Nicholas Lum, cross examining the witnesses of the opponent "live" on the stand. The witnesses for the mock arbitration were played by Richard Oakley (Managing Associate and Master Mariner of Hong Kong Office), Simon Cheng (Managing Associate of Hong Kong office) and Cindy Wang (Associate of Beijing office). Shirley Li (Partner of Shanghai office) narrated and explained arbitration for audience so that they understand what was happening.

This is the third mock arbitration that Ince Asia team has successfully organized and hosted, following the more recent one in Shanghai in March 2019, and the inaugural one in Beijing in May 2018.
