Ince has been providing hands-on advice on projects and matters in the African continent for decades.

We advise on transactions and disputes in Common law, Francophone and Lusophone jurisdictions in North West, East and Sub-Saharan Africa. Our track-record includes assistance to clients, often on site, in some of the most challenging business environments, across the entire continent.  Some of our Partners have worked as in house counsel in Africa, have unrivalled know-how and experience, both transactional and contentious, in particular in Angola, Mozambique, South Africa, Democratic Republic of Congo, Tanzania and Nigeria.

The Group is a global, multilingual team of Partners and Associates with a recognised international practice in their respective fields of expertise, ranging from international trade, finance, energy projects, insurance and reinsurance to commercial disputes.  A number of our team members are nationals of the relevant jurisdictions and understand the local context better than anyone.

The Group operates from our London, Paris, Beijing, Shanghai, Hong Kong and Dubai offices.  It focuses on Southern African Development Community (SADC) jurisdictions and advises multinationals in the mining and commodities sector, upstream and downstream energy players, lenders, private equity houses, export credit and multilateral agencies.  It also advises on projects and disputes in OHADA member states.


International Trade and Commodities

>  Advised one of the world’s largest dry bulk shipping operators as well as one of China’s largest commodity traders on shipping and international trade issues arising out of the Ebola crisis in the epidemic in Sierra Leone.

>  Acted in English High Court proceedings on a US$70 million claim for one of the largest independent oil and gas traders in relation to the default by various buyers in West Africa under various DES supply contracts for refined petroleum products.

Mining and Metals

>  Advised the owner in relation to a US$500 million investment in a tripartite PPP joint venture to mine iron ore in Angola.

>  Advised and drafted several offtakes for a copper concentrated mined out of Katanga Province in the Democratic Republic of Congo.

>  Advising an international consortium in relation to the sale and purchase of precious metals mined out of Angolan mines and subject to the Kimberley Process and new legislation that came into force in 2018.

Oil and Gas

>  Advised Golar in sealing  ground-breaking offshore energy deal with Perenco and SNH for the development of a floating liquefied natural gas export project off the coast of Cameroon. The project broke new ground both technically and commercially for the liquefied natural gas industry.

>  Advised Golar LNG on their contract with West Africa Gas Limited (“WAGL”) to provide FSRU services to support their LNG import project in Ghana. The transaction marks Sub-Saharan Africa’s first FSRU project.

Project and Asset Finance

>  Advised  on an integrated port and rail project for a BOT concession at the Port of Dar Es Salaam, Tanzania.

>  Advised HSBC in relation to the implementation of a US$500 million Finance Framework Agreement with the Angolan Ministry of Finance.

Power and Renewables

>  Advised on several large wind farm power plant PPP projects tendered for in round 1-4 in South Africa’s Renewable PPP program. Some of the projects are part of the first renewables IPPs in the country and one of the largest PPP programs in the world.

>  Advised on a 150MW wind farm in Ethiopia (the first renewables IPP in the country).

>  Advised The Export and Import Bank of China on financing a hydroelectric power plant in the Democratic Republic of Congo.

>  Advised on the investment and incorporation of a special purpose company to develop, manufacture, construct and operate a US$2.21 billion greenfield coal- fired power generation plant in Morocco.
